Breach of advertising standards - ResEvil:OpRa?

Hi

You lot are definately the right bunch for this gig!

Resident Evil: Operation Racoon is blatently displaying a 3D Ready badge on its homepage, scroll down to bottom of this link http://www.residentevil.com/reorc. The game could have displayed any vender specific batch but this time it was 3D Ready. The game is not mentioned on the nVidia game compatability site as 3D Ready but the 3D Ready badge is clearly on the Capcom site.

Aparently the 3D is pretty bad (I don't own the game so can't GG3D it); it is glitchy, 2D shadows etc. It is certainly no where near the standard one expects from nVidia's top badge.

At what point is the above breaking the law? Or is what Capcom doing perfectly legal and they are well within their right to say there game is of a certain quality when it is not?
